The UK government covers the legal fees of individuals who cannot afford to pay for legal representation. The Legal Aid Agency regulates who is eligible for legal aid and oversees practitioners who provide these services.

1. Type of Case
Legal Aid is not automatically available for all child arrangement disputes, but you may be eligible if:

• There is evidence of domestic abuse or child abuse, either towards you or the child.
• You are involved in proceedings where the local authority is involved (for example, care or supervision proceedings. Legal Aid is automatically available for parents in these cases).
• Your case involves abduction, forced marriage, or FGM protection orders.

For standard private law child arrangement cases (e.g. contact or residence disputes between separated parents), Legal Aid is only available if you can provide evidence of domestic or child abuse.

​2. Financial Eligibility
Your income and capital will be assessed. You may qualify if:

• Your gross monthly income is below £2,657 (higher if you have children).
• Your disposable monthly income is below £733.
• Your capital (savings, property, etc.) is below £8,000 in most cases.

Partial Legal Aid (with a contribution from you) may still be possible if you’re slightly over the limits.

3. Merits Test
This considers whether:

• The case has legal merit (a realistic prospect of success).
• It is reasonable to provide Legal Aid in the circumstances.
