Unlawful eviction Kicked out! But where’s the court order?
Evicting somebody from a tenancy without having got a Court order will more often than not be unlawful. Unlawful eviction is both a crime and a civil matter. It can be prosecuted as both. As a criminal matter that can result in penalties in the Criminal Courts. As a civil matter it can result in Injunctions and substantial damages.
It applies not only where you have been evicted but also if you are being harassed to give up your property without a Court Order telling you that you must leave.
If you are experiencing unlawful harassment of this sort or have been unlawfully evicted then please contact us as a matter of urgency. If you are a landlord and want to evict somebody without incurring criminal and civil liability then you may like to have our advice.
